1. Acceptance of Terms
By installing a Promofy app on your Shopify store, or by using promofyapp.com, you agree to these Terms of Service. If you do not agree, do not install or use our apps. Your use of Shopify is also governed by Shopify's own terms.
2. Our Apps
Promofy provides Shopify apps, including:
- Promotion Banners: announcement and sale banners for your storefront.
- Discount Banners: storefront display of discount codes and offers.
- Subscription Widgets: subscribe-and-save widgets for product pages.
- Multistore Sync: syncing of products, inventory and orders between Shopify stores.
3. Billing
- Paid plans are billed through Shopify and appear on your Shopify invoice.
- Plans renew automatically each billing cycle until you cancel or uninstall the app.
- Prices are shown in the Shopify App Store listing and inside the app before you approve a charge.
- We may change pricing with reasonable notice. Changes take effect only after you approve them in Shopify.
4. Your Responsibilities
- You are responsible for the content of your banners, offers and product data.
- You must make sure your promotions comply with the consumer laws that apply to your store.
- You must not use our apps for unlawful, misleading or harmful purposes.
- For Multistore Sync, you are responsible for checking your sync settings before enabling them.
5. Availability
We work to keep our apps available and reliable, but we do not guarantee uninterrupted service. Our apps depend on Shopify's platform and APIs, which may change or be unavailable outside our control.
6. Intellectual Property
The apps, their code and their design belong to Promofy. Installing an app gives you a limited, non-exclusive, non-transferable right to use it on your store while your installation is active. Your store data stays yours.
7. Limitation of Liability
To the maximum extent allowed by law, Promofy is not liable for indirect or consequential losses, including lost sales or profits. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.
8. Termination
You can stop using an app at any time by uninstalling it from your Shopify admin. We may suspend access if you breach these terms or use the apps unlawfully.
9. Governing Law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
